                                                                 ILLINOIS DRAM SHOP LIMITS

     The limits available to claimants under the various elements of the Illinois Dram Shop Act vary from year to year based upon changes in the consumer price index-u (CPI-U) during the preceding 12 months.  As a guide to our clients who write Dram Shop coverage, the following limits are provided:

                                                                 2007 Dram Shop Liability Limits

     For causes of action involving persons injured, killed, or incurring property damage on or after January 20, 2007, the judgment or recovery under the Act for injury to the person or property of any person shall not exceed $56,302.45 for each person incurring damages; and

     For causes of action under the Act for either loss of means of support or loss of society resulting from the death or injury of any person on or after January 20, 2007, the judgment or recovery shall not exceed $68,814.11.

                                                                 2008 Dram Shop Liability Limits

     For causes of action involving persons injured, killed, or incurring property damage on or after January 20, 2008, the judgment or recovery under the Act for injury to the person or property of any person shall not exceed $58,599.59 for each person incurring damages; and

     For causes of action under the Act for either loss of means of support or loss of society resulting from the death or injury of any person on or after January 20, 2008, the judgment or recovery shall not exceed $71,621.72.

                                                                2009 Dram Shop Liability Limits

     For causes of action involving persons injured, killed, or incurring property damage on or after January 20, 2009, the judgment or recovery under the Act for injury to the person or property of any person shall not exceed $58,652.33 for each person incurring damages; and

     For causes of action under the Act for either loss of means of support or loss of society resulting from the death or injury of any person on or after January 20, 2009, the judgment or recovery shall not exceed $71,686.18.

                                                                2010 Dram Shop Liability Limits

     For causes of action involving persons injured, killed, or incurring property damage on or after January 20, 2010, the judgment or recovery under the Act for injury to the person or property of any person shall not exceed $60,247.68 for each person incurring damages; and

     For causes of action under the Act for either loss of means of support or loss of society resulting from the death or injury of any person on or after January 20, 2010, the judgment or recovery shall not exceed $73,636.05.

                                                               2011 Dram Shop Liability Limits

     For causes of action involving persons injured, killed, or incurring property damage on or after January 20, 2011, the judgment or recovery under the Act for injury to the person or property of any person shall not exceed $61,151.39 for each person incurring damages; and

     For causes of action under the Act for either loss of means of support or loss of society resulting from the death or injury of any person on or after January 20, 2011, the judgment or recovery shall not exceed $74,740.59.
